Privacy Policy

This Privacy Policy explains how Pretty Ugly Tattoos, doing business as Pretty Ugly Collective (“we,” “us,” or “our”), 11130 S Tryon St, Suite 205, Charlotte, North Carolina 28273, collects, uses, shares and protects information when you visit prettyuglycollective.com (the “Site”), send us a booking inquiry, or join our email or text list.

The short version. We collect what you give us so we can answer your inquiry and do your appointment. We only send you marketing emails or texts if you asked for them, and you can stop them at any time. We do not sell your information, and we never share your phone number or your texting consent with anyone for their own marketing.

Information we collect

When you send a booking inquiry

Your name, email address, phone number, Instagram handle, pronouns, date of birth, the service you want, placement, size, budget, style, a description of your idea, reference photos you upload, your availability, whether you have been tattooed before, and anything else you choose to tell us.

When you join our email or text list

Your email address and/or mobile phone number, and your first name if you give it. So we can show that you asked to hear from us, we also keep a record of your consent: the date and time, the page you signed up on, the exact wording you agreed to, your IP address, and your browser and device type.

When you visit the Site

Our hosting and security providers automatically log basic technical information such as your IP address, browser type, device, and the pages you visit. This is used to keep the Site secure and running.

When you sign a consent form

If we send you our consent and release form to sign before your appointment, that form collects your name, date of birth, phone number, email, postal address, your answers to a short list of health questions (including any allergies or conditions you tell us about), your drawn signature, and whether you agree to let us photograph and share your work. If you are under 18 and booked for a piercing, it also collects your parent or legal guardian's name, relationship to you, ID number and signature. We keep the date, time, IP address and browser you signed from, together with the exact wording you agreed to, as proof of consent.

Your signed form is kept private to the studio. It is not shared with anyone else, it is not used for marketing, and it is not stored with our website's public files. We keep it for as long as we may need it as a record of your procedure, and you can ask us to delete it using the contact details below.

At the studio

ID checks are done in person at the studio.

How we use your information

To answer your inquiry, quote and schedule your appointment, and communicate with you about it.
To confirm you meet our age requirement.
To send you emails and/or text messages about openings, flash days, specials and news, only if you opted in to that channel.
To keep records of your consent and your opt-out choices, so we honor them.
To operate, secure and improve the Site, prevent spam and abuse, and comply with the law.

Marketing emails

We only add your email to our list if you join through the signup on the Site or tick the email box on the booking form. Every marketing email includes a way to unsubscribe. You can also unsubscribe at any time by emailing [email protected]. Even after you unsubscribe, we may still email you about an inquiry or appointment you made.

Text messages

We only send marketing text messages to people who checked the box agreeing to receive them. Giving us your phone number on the booking form does not sign you up for marketing texts. Consent is never a condition of booking or buying anything.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with any third parties, except the service providers that deliver our messages on our behalf, who may use it only to provide that service. All of the sharing described below excludes text messaging opt-in data and consent.

How we share information

We do not sell your personal information, and we do not share it with anyone for cross-context behavioral advertising. We share information only with:

Service providers who help us run the Site and our business, and only as needed for that work: FormSubmit (delivers inquiry forms to our inbox), Cloudflare (hosting, security and delivery), our server and backup storage providers, Google Fonts (loads the Site’s typefaces), and any email or text messaging platform we use to send messages you signed up for.
Legal and safety reasons, when required by law, or to protect the rights, property or safety of our clients, us, or others.
A business transfer, if the business is sold or reorganized, in which case this policy continues to apply to your information.

Cookies and local storage

The Site does not use advertising or cross-site tracking cookies. Cloudflare may set cookies needed for security. The Site also stores a small note in your own browser remembering whether you closed or joined the email and text signup, so it does not keep asking you. That note stays on your device and is not sent to us. You can clear it, or block cookies, in your browser settings.

How long we keep information

Inquiries are kept as long as needed to respond to you and to keep reasonable business records. You can ask us to delete yours at any time.
List signups are kept until you ask us to delete them. If you unsubscribe, we keep your email or number marked as unsubscribed so we do not contact you again.
Consent and opt-out records are kept for as long as the law may require us to show that we had your permission or honored your request to stop, even after you unsubscribe. We keep only what is needed for that purpose.

How we protect information

Inquiries and list signups are stored on a private server that only the studio can access, behind a password. Backups are kept, and copies stored off-site are encrypted. No method of sending or storing information over the internet is 100% secure, but we take reasonable steps to protect yours.

Your choices and rights

You can ask us to access, correct or delete the personal information we hold about you, or to stop contacting you, by emailing [email protected]. To stop texts, reply STOP. To stop emails, use the unsubscribe link or email us. We will respond within 45 days, may need to confirm your identity first, and will not treat you differently for making a request. Depending on where you live, you may have additional rights under laws such as the California Consumer Privacy Act or similar state privacy laws; we will honor those rights as they apply.

Age

Tattoos and permanent makeup are for adults 18 and older, and so are our email and text list. A piercing for someone under 18 requires their parent or legal guardian to complete and sign the consent form with them, which is the only case where we collect information about a minor. The Site is not directed to children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has sent us information, email us and we will delete it. Changes to this policy

We may update this Privacy Policy from time to time. The “last updated” date above shows the most recent version. If we make a material change to how we use your contact information for marketing, we will ask for your consent where the law requires it.
